1. Acceptance of Terms

By accessing and using Desviados.net (hereinafter the "Platform"), you fully agree to these Terms of Use. If you do not agree with any provision, you must not use the Platform.

The Platform is intended for the publication and sharing of off-mainstream literature, microfiction, and personal accounts. The focus is on original writing and the curation of independent narratives.

2. Eligibility and Conduct

By accessing the Platform, you declare and warrant that:

• You have legal capacity to accept these Terms;
• You will use the Platform in accordance with applicable law;
• You accept responsibility for the accuracy of the information provided.

3. Registration and User Account

3.1. Account Creation

To use certain features, you must create an account by providing truthful, complete, and up-to-date information. You are responsible for the confidentiality of your password and for all activities carried out on your account.

3.2. Voluntary Deactivation

You can deactivate your account at any time through profile settings. Deactivation:

• Hides all your content (texts, media, comments, and badges);
• Removes your profile from public lists and rankings;
• Prevents access to the platform until you log in again;
• Allows automatic reactivation when you log in again with your credentials, instantly restoring all your content and visibility.

3.3. Permanent Deletion

To request permanent deletion of your account and personal data, contact us via [email protected]. Permanent deletion is irreversible and results in the definitive removal of your data according to our Privacy Policy.

3.4. Password Recovery

If you forget your password, use the "Forgot password" function on the login page. You will receive an email with reset instructions. The link is valid for 24 hours.

4. Privacy and Visibility Controls

4.1. Content Privacy Settings

When publishing content, you can define visibility levels:

• Public: Visible to all visitors;
• Logged-in Users Only: Visible only to authenticated users;
• Followers Only: Visible only to people who follow you;
• Private: Visible only to you.

4.2. Private Profile

You can enable the "Private Profile" option in settings, which:

• Hides your profile from all public lists (rankings, top users, public badges);
• Prevents third parties from viewing your profile through direct links;
• Hides your content from public lists and searches;
• You and platform administrators can still view your profile normally.

5. Content: Permissions and Restrictions

5.1. Permitted Content

You may publish texts, microfiction, personal accounts, images, and comments with creative freedom, provided you respect the legal and ethical restrictions established in these Terms.

5.2. Strictly Prohibited Content

It is strictly prohibited to publish:

• Content exposing minors: any material that places minors at risk, under exploitation, or in improper exposure;
• Real violence or incitement to violence: material that encourages assaults, threats, or crimes;
• Harassment and hate speech: attacks on people or groups based on race, gender, religion, orientation, disability, or origin;
• Exposure of personal data: disclosure of third-party private information without authorization;
• Copyright infringement: protected material without authorization;
• Spam and malware: deceptive advertising, malicious links, or content that compromises security.

5.3. Rights Over Content

You declare that you hold all necessary rights to the published content and grant the Platform a non-exclusive, worldwide, royalty-free license to display, store, and distribute your content as necessary for the operation of the service.

6. Responsibilities and Moderation

All published content is the sole responsibility of the authoring user. The Desviados.net team:

• Reserves the right to moderate, remove, or hide any content that violates these Terms;
• Is not responsible for content generated by third parties;
• May suspend or terminate accounts that repeatedly violate the rules;
• Will cooperate with competent authorities upon legal order.

7. Reports and Security

If you identify illegal, abusive, or Terms-violating content, report it using the reporting feature available on the platform or by email at [email protected].

Access logs, IP addresses, and metadata are stored for security purposes and may be provided to authorities upon legal request.

8. Intellectual Property

The Platform, including its design, source code, brand, and visual elements, is protected by intellectual property rights. Reproduction, distribution, or commercial use without express authorization is prohibited.

9. Limitation of Liability

The Platform is provided "as is." We do not guarantee uninterrupted availability, absence of errors, or absolute security. Under no circumstances will we be liable for indirect damages, lost profits, or losses resulting from use of the platform.

10. Changes to the Terms

We reserve the right to modify these Terms at any time. Changes take effect immediately upon publication. Continued use of the Platform after changes constitutes acceptance of the new Terms.

11. Governing Law and Jurisdiction

These Terms are governed by Brazilian law. Any disputes shall be resolved in the courts of São Paulo/SP, with waiver of any other jurisdiction, however privileged.
